Will I receive a 1099 form every year?
No. The IRS does not require 1099 forms for Royalty Interest income of less than $10 and Working Interest income or Rental income of less than $600 in a year.

When are 1099 forms mailed?
Your 1099 form will be mailed no later than January 31st. If the 31st falls on Saturday or Sunday, the IRS allows for mailing the following Monday.

Why is my 1099 form more than what I received?
Your 1099 total is the gross income earned prior to any joint interest billing netting, as required by the IRS. In order to reconcile your 1099 to what you were paid, you will need to deduct any expenses netted throughout the year from your 1099 total. If you have questions as to how this information should be presented on your tax return, please contact a tax professional.

How do I request a copy or replacement of my 1099?

Why are unclaimed funds paid to the State?
Each state has abandoned property or escheat laws that require the reporting of funds held for its residents. Once abandoned property has reached each state’s required dormancy period, it is paid to the state of the owner’s last known address. Funds are escheated to the state of the owner’s last known address if we do not have a valid address or if we cannot locate the heirs of a deceased owner.

How do I research unclaimed funds?
Each state makes an effort to locate rightful owners of unclaimed funds through a single organization, holding the funds until the owner is found. To locate and collect unclaimed funds, please visit:

When does APEX remit royalty payments?
Oil and Gas royalty payments are normally paid within 60 days after the end of the production.

Royalty checks are processed on the last day of each month and mailed the following business day. If the last day falls on a weekend or holiday, checks will be processed the following business day and mailed the next day.

What is Minimum Pay and Minimum Release?
A check is issued once an owner’s account accumulates a minimum balance of $50.
Each year in September we have a minimum release of all accounts with a balance of at least $10.

Why have I not received my revenue check?
The most common reason is because your account has not reached the minimum pay status of $50.

Postal delays may cause your check to arrive a few days late. Please allow ten (10) business days for delivery by the postal service.

It is possible that royalty payments may be suspended or held in suspense. Generally, royalty payments may be suspended for several reasons including, but not limited to, the following: a missing Tax ID, insufficient address, assignment of interest, notice of death, lack of documentation/title confirming ownership, or disputes involving proper apportionment or ownership of interests in the minerals produced. Amounts due are accumulated and are released when the matter in question has been resolved and all related documents have been received and processed. What should I do if I have not cashed my check and it is more than 120 days after the issue date?
If your check has not cleared the bank within 120 days of issuance, APEX will no longer honor the check. We void stale dated checks that are past the 120 day mark.

Please contact APEX to re-issue the funds with your next check. Please include the following information:

A levy is a notice issued by a taxing authority, such as the Internal Revenue Service (IRS), Texas Comptroller, Child Support Agency, Veterans Land Board, etc. This notice states that the taxpayer owes overdue taxes or payments and that payments which APEX normally remits to the taxpayer should be sent directly to the taxing authority or agency. APEX cannot release the levy against your account. You will need to contact the agency directly.

Once you obtain a Release of Levy from the taxing authority or agency, please send this written notification to APEX and include the following information:

  • Written statement from the taxing authority or agency

  • Owner died without a Will (intestate) and the Estate is under administration
    • Death Certificate
    • Letters of Administration Proceedings
    • Affidavit of Heirship filed of record in the county the property is located
    • Evidence of payment of debts and taxes
    • Certificate of Transfer or other documentation evidencing final distribution of property by the court through Laws of Descent and Distribution
  • Owner died without a Will (intestate) and under no administration
    • Death Certificate
    • Affidavit of Heirship properly completed and notarized. It should be executed by a disinterested party (e.g. person who has no personal or financial stake in the outcome) and recorded in the county where this property is located
  • Owner having a Life Estate dies
    • Death Certificate
    • Copy of recorded document creating the Life Estate

  • Appointment of Attorney-In-Fact
